Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and HBKL Labs ("HBKL Labs", "we", "us") for your use of the Anchored application and related services (the "app"). By downloading, subscribing to, or using the app, you agree to these Terms. If you do not agree, do not use the app. This agreement also serves as the end user license agreement (EULA) for the app.

1. The service

Anchored delivers a personalized daily audio news briefing generated from public news and RSS sources. The app requires an account and an active subscription to use.

2. Eligibility and accounts

You must be at least 13 years old, and old enough to form a binding contract in your jurisdiction, to use the app. You create an account using Sign in with Apple. You are responsible for activity that occurs under your account and for keeping your device and Apple ID secure.

3. License

Subject to these Terms and your active subscription, HBKL Labs grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by law.

4. Subscriptions, billing, and auto-renewal

  • The app is offered on a paid subscription basis. Subscription tiers and features are described in the app. Access to briefings requires an active subscription. Every plan starts with a 3-day free trial.
  • Subscriptions are sold through your Apple App Store account and are billed to your Apple ID. The price, billing period, and any introductory or trial terms are shown to you in the app at the time of purchase and must be confirmed before payment.
  • Auto-renewal: subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the current period ends, at the then-current price for your plan.
  • Managing and canceling: you can manage or cancel your subscription, or turn off auto-renewal, in the App Store: open Settings on your device, tap your name, then Subscriptions. Deleting the app does not cancel a subscription.
  • Refunds: purchases are handled by Apple, and refunds are subject to Apple's policies. HBKL Labs cannot directly issue refunds for App Store purchases. Except where required by law, payments are non-refundable and unused portions of a period are not refunded on cancellation.
  • Changes: we may change subscription prices or the features included in a tier. Price changes are handled through Apple and, where required, will be communicated to you and take effect on your next renewal. Continued use after a change takes effect constitutes acceptance.

Apple's Standard End User License Agreement (the "Licensed Application End User License Agreement") also applies to your use of the app, and where it conflicts with these Terms in Apple's favor for App Store distribution, Apple's terms govern that specific matter.

5. Acceptable use

You agree not to:

  • use the app for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to the service, other accounts, or our systems or those of our providers;
  • interfere with or disrupt the service, or circumvent any usage limits, security, or subscription controls;
  • copy, redistribute, publicly perform, or resell briefing audio, text, or answers, or use them to build or train a competing product or dataset;
  • use automated means to scrape, harvest, or extract content from the service; or

6. AI-generated content and no reliance

Briefings are produced automatically by language models and text-to-speech systems from third-party public news sources. This content is provided for general information only. It may be inaccurate, incomplete, outdated, or misattributed, and it does not represent the views of HBKL Labs. It is not professional, legal, financial, medical, or other advice, and you should not rely on it as your sole source of information or for any decision that has significant consequences. You are responsible for verifying important information with primary sources. The underlying news is owned by its respective publishers; we do not claim ownership of third-party source material.

7. Intellectual property

The app, its software, design, and the arrangement and presentation of briefings are owned by HBKL Labs and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

8. Third-party services

The app relies on third-party services, including Apple, Supabase, and OpenAI, and on third-party news sources. Their availability, terms, and content are outside our control, and we are not responsible for them. See our Privacy Policy for how data is processed.

9. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, timely, or that briefings or answers will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, HBKL Labs and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the app or its content, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold HBKL Labs harmless from any claims, damages, or expenses arising out of your misuse of the app or your violation of these Terms or applicable law.

12. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination (including sections 6, 7, 9, 10, and 11) will survive.

13. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and you and HBKL Labs submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York for any dispute not subject to arbitration or a small-claims option, except where applicable law grants you the right to bring a claim in your local courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the date above and, where appropriate, notify you in the app. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.
